A man is deported despite a court order to the contrary. For the Greens, this is an affront. How could this happen?

After the deportation of a Moroccan despite a court ruling to the contrary, the Greens in the state parliament are demanding clarification from the Saxon Ministry of the Interior.

He expects an explanation from head of department Armin Schuster (CDU) as to "how this could have happened and what measures are being taken to ensure that court decisions are implemented by the administration at all times", said Valentin Lippmann, the Greens' legal policy spokesperson. In a minor interpellation, he requested more detailed information on what had happened.

According to the Refugee Council, a Moroccan was deported on July 11, even though the Chemnitz Administrative Court ruled in an urgent decision that the deportation must be suspended. Despite telephone calls from the man's lawyer, the Saxon authorities had not forwarded the court order to the federal police, who therefore continued the deportation.

On Thursday, the state directorate announced in response to an inquiry that it had learned of the court order while the deportation was ongoing. However, the authority was not involved in the court proceedings. In the short time available, a decision had been made against stopping the ongoing deportation. The case is being evaluated internally and the possibility of the Moroccan being allowed to re-enter the country temporarily is also being examined.
