Consumer advice center: Violations in home cost increases

Caution is advised when nursing homes ask residents to pay more. According to the consumer advice center, the letters are not always legal.

According to its own information, the Saxony Consumer Advice Center has identified clear legal violations in some cases of fee increases in care homes. "Often, fee increase letters are unclear, non-transparent or do not meet the formal requirements," said Micaela Schwanenberg, a consultant in the legal team at the Saxony Consumer Advice Center, according to a press release.

Legal deadlines are not adhered to and central legal principles are disregarded. Contractual clauses are also not always lawful, according to the statement. The consumer advice center is calling on people in need of care and their relatives to submit current fee increase letters and associated care home contracts for review. According to the statement, the aim is to find out whether the violations identified are isolated cases or whether there is a systematic problem.

Residents of care homes pay a co-payment for care and support, as care insurance only covers part of the costs. In addition, there are costs for accommodation, meals and investments in the facilities. As of January 1 of this year, according to data from the Association of Substitute Health Insurance Funds in Saxony, an average of €2,381 per month was due out of pocket in the first year in a home.
