Refugees can legally defend themselves against a rejection of their asylum application. After a decline, the number of appeals to administrative courts is now on the rise again - the judiciary is assuming a clear trend.

The number of complaints in asylum matters at Saxony's administrative courts is on the rise again after a decline. "Receipts in asylum cases are rising noticeably, but have not yet reached a level that would make proper processing impossible," a spokesman for the Higher Administrative Court (OVG) in Bautzen said when asked.

According to OVG data, 5205 receipts were recorded at the asylum chambers in 2022. The statistics show 4020 asylum complaints and 1185 applications for interim legal protection - so-called urgent proceedings. Compared to the previous year, just under 560 more asylum appeals were received, an increase of around 14 percent. Compared with 2020, the figure was only around 290 and a good seven percent higher. In urgent proceedings, however, there was a decrease of 50 proceedings in 2022 compared to 2021 - and compared to the year before even 115.

With 1488 arrivals and about 29 percent of all asylum proceedings, the main burden was, as in the two previous years, at the Dresden Administrative Court. In addition to Dresden, there are also administrative courts in Chemnitz and Leipzig in Saxony. The Higher Administrative Court is located in Bautzen.

In 2022, 5212 asylum cases were settled at first instance, of which 4036 were complaints. In most cases, people from Iraq, Venezuela and Turkey objected to a decision from the Federal Office for Migration and Refugees (BAMF). This year, Venezuela, Turkey and Syria are in the lead.
